By registering for, accessing, or using the Elite ESP Building website (“Platform”), you agree to be bound by these Terms and Conditions.
If you do not agree, you must not register or use the Platform.
This Platform is provided by the Owners Corporation – Elite ESP Building (“Owners Corporation”, “we”, “us”, “our”).
2. Purpose of the Platform
The Platform is provided solely for:
- Owners and registered occupants of lots within Elite ESP Building
- Strata Committee members
- Authorised strata managing agents
- Approved contractors (where applicable)
The Platform may be used for:
- Submitting service or maintenance requests
- Receiving building communications
- Accessing strata-related documents (where permitted)
- Committee administration functions
The Platform is not intended for emergency reporting. In emergencies, users must contact emergency services or the strata manager directly.
3. Eligibility and Registration
You may only register if you are:
- A registered lot owner
- A tenant authorised by the lot owner
- A strata committee member
- A strata managing agent representative
- An authorised contractor
We may verify your identity and lot entitlement before approving registration.
We reserve the right to refuse or suspend registration at our discretion.
4. Account Security
You must:
- Provide accurate and current information
- Maintain confidentiality of your login credentials
- Notify us immediately of unauthorised access
The Owners Corporation is not liable for loss resulting from unauthorised use of your account due to your failure to safeguard credentials.
5. Service Requests and Maintenance Reporting
By submitting a service request, you acknowledge:
- The request does not constitute formal notice under legislation unless separately required by law.
- The Owners Corporation may determine whether the issue relates to common property or private lot property.
- Timeframes for response are subject to contractor availability, priority classification, and funding approval.
The Owners Corporation is not liable for delays caused by:
- Contractor unavailability
- Funding constraints
- Access issues
- Events outside reasonable control
6. No Legal Advice
Information provided on the Platform is for general information only.
Nothing on the Platform constitutes:
- Legal advice
- Financial advice
- Engineering certification
- Compliance certification
Users should obtain independent professional advice where required.
7. Limitation of Liability
To the maximum extent permitted by law:
The Owners Corporation is not liable for:
- Loss arising from reliance on information on the Platform
- Indirect or consequential loss
- Loss caused by system outages or cyber incidents
- Errors in user-submitted information
Nothing in these Terms excludes liability that cannot be excluded under Australian Consumer Law.
8. Privacy and Data Collection
We collect personal information to:
- Verify lot ownership or residency
- Manage maintenance and service requests
- Communicate strata matters
- Comply with legal obligations
Information may be disclosed to:
- Strata managing agents
- Contractors
- Insurers
- Legal advisers
- Government authorities where required by law
All personal information is handled in accordance with the Privacy Act 1988 (Cth).
A separate Privacy Policy should be available and linked.
9. Acceptable Use
Users must not:
- Upload unlawful, defamatory, or abusive content
- Harass committee members, residents, or contractors
- Use the Platform for commercial advertising
- Attempt to interfere with system security
- Upload malicious software
We may suspend or terminate accounts for breach.
10. Intellectual Property
All website content is owned by or licensed to the Owners Corporation.
Users may not reproduce or distribute materials without permission, except for personal strata-related use.
11. Committee Functionality (If Applicable)
Committee members using administrative features acknowledge:
- Decisions must comply with strata legislation
- Platform tools do not replace formal resolutions
- Voting and decisions must still follow legislative requirements
The Platform does not replace statutory meeting procedures.
12. System Availability
We do not guarantee uninterrupted access.
The Platform may be:
- Updated
- Modified
- Suspended
- Discontinued
Without prior notice.
13. Indemnity
You agree to indemnify the Owners Corporation against any claims, loss, or liability arising from:
- Your misuse of the Platform
- False or misleading submissions
- Breach of these Terms
14. Governing Law
These Terms are governed by the laws of New South Wales, Australia.
Any disputes are subject to the jurisdiction of:
- NSW Civil and Administrative Tribunal (NCAT), or
- Courts of New South Wales, where applicable
15. Amendments
We may amend these Terms at any time.
Updated Terms will be posted on the Platform. Continued use constitutes acceptance.
